On Wednesday, March 8, 2023, Middlesboro Police Sgt. Nick Capps arrested a man that had been the focus of a call at Pinnacle Homes days prior to being taken into custody.
Sgt. Capps responded to a complaint call at Pinnacle Homes in reference to a dog being kicked in the face. Once on scene, the sergeant spoke to three juveniles and an adult.
One of the juveniles showed him a video of 22-year-old Damien Russell of Middlesboro attempting to pull another juvenile, approximately 15-years-old, out of the residence by his shirt and his arm. This action caused the side of the juvenile's head to hit the wall. Once Russell was not able to pull the juvenile from the residence, he then stepped inside the home began cursing and instigating a fight.
The home Russell entered was not his house, nor the individuals house that he tried to pull from the home.
Once Russell realized the individual was not going to fight him, he then walked out of the residence and kicked an eleven pound dog in the face, causing injuries to the animal. The owners of the dog had to take the animal to the vet the following morning for treatment of the injuries.
Damien Russell was lodged in the Bell County Detention Center charged with harassment with physical contact, criminal trespass - 1st degree, and cruelty to animals - 2nd degree.
